These Terms and Conditions of Service ("Terms") constitute a legal agreement between you and FingerGiant Ltd ("Company") and govern your use of the SMS, Email, and USSD services provided by the Company through the platform GiantSMS (“Product”). By using the Company's Product, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Company's services.

"SMS" means short message service, a communication protocol used to send text messages between mobile devices.
"Email" means electronic mail, a method of exchanging digital messages between computers, tablets, and other devices over the internet.
"USSD" means unstructured supplementary service data, a communication protocol used to send text messages between a mobile phone and an application program in the network of a mobile network operator.
"Service" means the SMS, Email, and USSD services provided by the Company.

Use Of Service

You are solely responsible for the content of the messages you send using the Company's services. You agree not to use the Company's services for spamming or sending unsolicited messages.

You agree not to use the Company's services to send any content that is defamatory, obscene, indecent, or that infringes on any third-party intellectual property rights.

You agree to indemnify and hold harmless the Company and its affiliates, officers, directors, employees, and agents from any claims, damages, liabilities, or expenses (including reasonable attorneys' fees) arising from your use of the Company's services.

Payments

Payment for the Company's services must be made in accordance with the pricing and payment terms set forth on the Company's website.

The Company reserves the right to change its pricing and payment terms at any time without notice.

All sales are final. The Company does not issue refunds for any reason.

Intellectual Property

The Company retains all rights, title, and interest in and to its services, including all intellectual property rights.

You may not copy, modify, distribute, sell, or lease any part of the Company's services, nor may you reverse engineer or attempt to extract the source code of any software included in the Company's services.

Termination

We reserve the right to terminate your use of our services at any time, without notice, if we believe that you have breached any of these Terms and Conditions, or if we believe that your use of our services may cause harm to us, our users, or any third party. You may also terminate your use of our services at any time by providing us with written notice. Upon termination, your access to our services will be immediately terminated.
